These Website Terms and Conditions (“Terms”) govern access to and use of the website, forms, online giving services, event and ministry registrations, communications, livestreams, digital content, and other online services provided by Faith Apostolic Gospel Temple (“FaithAGT,” “we,” “us,” or “our”). Collectively, these are referred to as the “Services.”

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Certain programs, transactions, portals, events, ministries, or features may have additional rules, notices, consent forms, waivers, eligibility requirements, or terms. If additional terms conflict with these Terms, the additional terms will govern the specific service to which they apply.

1. Acceptance of These Terms

You may use the Services only if you agree to these Terms. Your continued access to or use of the Services after updated Terms are posted constitutes acceptance of the revised Terms, except where applicable law requires a different form of notice or consent.

If you use the Services on behalf of a household, group, church, ministry, organization, business, or other entity, you represent that you are authorized to act on its behalf and bind it to these Terms.

2. About FaithAGT and the Services

FaithAGT is a religious and charitable ministry. The Services may provide information or functionality relating to:

  • Worship services, ministries, and church activities;
  • Prayer, pastoral-care, baptism, baby dedication, wedding, funeral, and counseling requests;
  • Membership, visitor, and ministry-interest forms;
  • Conferences, Community Day, youth programs, educational programs, and other events;
  • Food Pantry and community outreach ministries;
  • Volunteer opportunities and ministry assignments;
  • Online giving, recurring donations, memorial gifts, and event payments;
  • Email, SMS, MMS, telephone, and other communications;
  • Livestreams, sermons, videos, photographs, and educational resources;
  • Future member, volunteer, ministry leader, directory, check-in, mobile, and giving services; and
  • Other religious, charitable, educational, administrative, and community services.

FaithAGT may add, modify, suspend, or discontinue all or part of the Services at any time, subject to applicable law.

3. Eligibility and Authority

You must be legally capable of agreeing to these Terms. Children under 13 should not use general website forms independently. A parent, legal guardian, or authorized adult should complete forms and registrations for a child where appropriate.

When registering another participant, household member, minor, or group member, you represent that:

  • You are authorized to provide the submitted information;
  • The information is accurate and complete to the best of your knowledge;
  • You have obtained any consent required from the participant, parent, or guardian; and
  • You will communicate relevant event, safety, privacy, and participation information to that person.

4. Acceptable Use

You agree to use the Services only for lawful and appropriate purposes. You may:

  • Review public information about FaithAGT and its ministries;
  • Submit genuine ministry, registration, assistance, volunteer, or communication requests;
  • Make authorized donations and payments;
  • View, listen to, or share links to public FaithAGT content for personal and noncommercial purposes; and
  • Use the Services in accordance with these Terms and any program-specific requirements.

5. Prohibited Conduct

You may not:

  • Use the Services for an unlawful, fraudulent, deceptive, abusive, harassing, threatening, or harmful purpose;
  • Submit false, misleading, fraudulent, or unauthorized information;
  • Knowingly provide false eligibility or household information for charitable assistance;
  • Impersonate another person or misrepresent your authority or affiliation;
  • Attempt to gain unauthorized access to any account, system, record, form, database, or network;
  • Bypass or interfere with authentication, access controls, rate limits, security measures, or consent controls;
  • Introduce malware, malicious code, harmful files, or disruptive technologies;
  • Probe, scan, or test the vulnerability of the Services without written authorization;
  • Scrape, harvest, extract, index, or collect content or personal information through automated means without permission;
  • Use bots, scripts, or automated tools in a manner that burdens or interferes with the Services;
  • Send spam, unsolicited promotions, chain messages, or unauthorized solicitations;
  • Use information obtained through the Services to harass, target, exploit, or market to another person;
  • Copy, republish, sell, license, modify, or commercially exploit protected FaithAGT content without permission;
  • Remove copyright, trademark, attribution, or proprietary notices;
  • Use FaithAGT’s name, logo, ministries, or content in a manner that falsely suggests endorsement or affiliation;
  • Interfere with another person’s use of the Services; or
  • Encourage or assist another person in violating these Terms.

6. Information You Submit

You agree to provide information that is accurate, current, relevant, and complete. You are responsible for reviewing information before submission and correcting material errors.

Do not submit Social Security numbers, complete payment-card information, online-banking passwords, detailed medical records, government-issued identification numbers, biometric data, or other highly sensitive information through a general website form unless FaithAGT specifically requests the information through an authorized and appropriately secured process.

FaithAGT handles personal information in accordance with its Privacy Policy.

7. Forms and Third-Party Service Platforms

FaithAGT’s website may link to or embed forms and services hosted through a trusted third-party ministry relationship-management, payment, communications, or service platform. These may include:

  • Contact Us;
  • Prayer Request;
  • Event, conference, Community Day, and youth registration;
  • Food Pantry registration and appointment requests;
  • Volunteer registration;
  • Membership application and new visitor forms;
  • Donation and recurring-giving forms;
  • Newsletter and communication sign-up;
  • Baptism and baby dedication requests;
  • Wedding, funeral, and counseling requests; and
  • Other ministry forms.

A link or embedded form may be subject to the supporting provider’s technical terms and privacy practices in addition to FaithAGT’s policies.

8. Current and Future Accounts or Portals

FaithAGT does not currently provide general visitor logins, a member portal, a volunteer portal, or a public online church directory through the website. FaithAGT may introduce accounts or portals in the future.

If an account or portal is introduced, you agree to:

  • Provide accurate account information;
  • Maintain the confidentiality of usernames, passwords, and authentication codes;
  • Use only accounts you are authorized to access;
  • Notify FaithAGT promptly of suspected unauthorized access;
  • Keep contact information current; and
  • Comply with any additional portal or directory rules.

You are responsible for activity occurring through your credentials to the extent permitted by law. FaithAGT may suspend or disable an account to protect security, privacy, ministry operations, or other users.

9. Intellectual Property

Unless otherwise stated, the Services and their contents are owned by, licensed to, or used with permission by FaithAGT and are protected by copyright, trademark, and other intellectual property laws.

Protected content may include:

  • FaithAGT’s name, logos, ministry names, marks, and branding;
  • Sermons, teachings, devotionals, presentations, and educational materials;
  • Website text, graphics, photographs, videos, audio, livestreams, and recordings;
  • Documents, forms, publications, newsletters, and downloads;
  • Page layouts, design elements, and original website content; and
  • Other materials created by or licensed to FaithAGT.

No ownership right is transferred to you by your use of the Services.

10. Permitted Use of Content

Unless a specific notice states otherwise, FaithAGT grants you a limited, revocable, nonexclusive, nontransferable license to access and use public content for personal, noncommercial, religious, educational, or ministry purposes.

You may:

  • View or listen to public content;
  • Print a reasonable number of copies for personal use;
  • Share a link to public FaithAGT content; and
  • Quote a brief portion with proper attribution where legally permitted.

You may not, without prior written permission:

  • Republish substantial content on another website, platform, publication, or database;
  • Sell, sublicense, or commercially exploit FaithAGT content;
  • Modify content in a misleading or harmful manner;
  • Create unauthorized derivative works;
  • Use content for model training, automated extraction, or commercial data development;
  • Use photographs, videos, or recordings to identify, profile, or target individuals; or
  • Use FaithAGT content in a way that falsely implies approval, sponsorship, or endorsement.

11. User Submissions and Ministry Content

You may submit prayer requests, testimonials, feedback, comments, photographs, recordings, written materials, registration information, or other content (“User Content”).

You retain any ownership rights you hold in your User Content. By submitting User Content for publication, promotion, testimony, ministry use, or other distribution, you grant FaithAGT a nonexclusive, worldwide, royalty-free license to use, reproduce, display, publish, edit for clarity or length, archive, and distribute that content for the purpose for which it was submitted.

This license does not authorize FaithAGT to publish a prayer request, counseling request, private pastoral communication, Food Pantry record, or other information submitted with a reasonable expectation of confidentiality unless you separately authorize publication or disclosure.

You represent that:

  • You own or have permission to submit the User Content;
  • The User Content is accurate to the best of your knowledge;
  • The submission does not unlawfully violate another person’s rights; and
  • The submission does not contain unlawful, defamatory, threatening, malicious, or infringing material.

FaithAGT may decline, remove, edit, or restrict User Content at its discretion where legally permitted.

12. Prayer Requests, Pastoral Care, and Counseling

FaithAGT seeks to handle prayer requests, pastoral-care inquiries, and counseling requests respectfully and confidentially. Private requests may be shared with authorized pastors, ministry leaders, prayer personnel, or other individuals who need the information to provide an appropriate ministry response.

You should clearly indicate when you authorize broader sharing with a prayer group, congregation, publication, livestream, or other audience.

FaithAGT may be required or permitted to disclose information where necessary to comply with law, respond to abuse or safety concerns, protect a person from harm, or address an emergency.

Prayer, pastoral care, and ministry counseling are not substitutes for licensed medical, mental-health, legal, financial, emergency, or public safety services.

13. Donations and Charitable Giving

Donations are voluntary. FaithAGT may accept one-time gifts, recurring gifts, anonymous gifts, memorial gifts, restricted gifts, event-related payments, and gifts designated to approved ministries, campaigns, or charitable purposes.

Before completing a transaction, review the amount, designation, recurrence, and donor information carefully. You represent that:

  • You are authorized to use the selected payment method;
  • The information provided is accurate;
  • The transaction is not fraudulent or unlawful; and
  • You understand any recurring-giving instructions selected.

Payment credentials are processed by a third-party payment processor. FaithAGT does not intend to store complete payment-card numbers or card-security codes on its website servers.

Any statement about deductibility is general information only. The tax treatment of a contribution depends on individual circumstances and applicable law. Donors should consult a qualified tax advisor.

14. Restricted, Memorial, and Designated Gifts

FaithAGT will make reasonable efforts to use a designated gift for the identified ministry, fund, memorial, campaign, or charitable purpose. However, unless a legally binding written agreement accepted by FaithAGT states otherwise, FaithAGT retains discretion and control over contributed funds as required for charitable and religious administration.

If a designated purpose is completed, overfunded, impracticable, discontinued, inconsistent with FaithAGT’s mission, or no longer available, FaithAGT may apply the funds to a reasonably related ministry or charitable purpose, subject to applicable law and any binding restrictions.

An “anonymous” gift generally means the donor’s name will not be publicly disclosed. FaithAGT and its payment, accounting, or compliance providers may still retain identity and transaction information for internal, legal, tax, security, and recordkeeping purposes.

15. Recurring Giving

By establishing a recurring donation, you authorize the selected amount to be charged according to the schedule you choose until the authorization is changed, canceled, expires, or is otherwise terminated.

You are responsible for keeping payment and contact information current. To modify or cancel a recurring gift, use any available account or payment management feature or contact FaithAGT with reasonable advance notice. Changes may not affect a payment already submitted for processing.

16. Refunds, Cancellations, and Charge Disputes

Charitable donations are generally final and nonrefundable except when:

  • A duplicate or incorrect transaction occurred;
  • An unauthorized transaction is verified;
  • Applicable law requires a refund; or
  • FaithAGT approves a refund based on the circumstances.

Event, ticket, meal, registration, merchandise, or program payments may be subject to event-specific cancellation and refund terms. Unless otherwise stated, fees paid to third parties, payment-processing costs, purchased supplies, or amounts already committed may be nonrefundable where legally permitted.

Submit refund or transaction questions promptly to ministry@faithagt.org. Include sufficient information for FaithAGT to identify the transaction, but do not email complete payment-card information.

Before initiating a payment dispute or chargeback, please contact FaithAGT so we can attempt to investigate and resolve the matter. This does not limit any rights you may have under applicable law or payment-network rules.

17. Events, Conferences, and Program Registration

Event and program availability may be limited. Registration does not guarantee admission until any required confirmation, payment, eligibility, or approval process is completed.

You agree to comply with applicable event rules, safety instructions, ministry standards, venue rules, schedules, and codes of conduct.

FaithAGT may:

  • Change speakers, schedules, activities, meals, venues, formats, or program details;
  • Limit or close registration;
  • Correct pricing, capacity, or registration errors;
  • Cancel, postpone, reschedule, relocate, or convert an event to an online format;
  • Deny or revoke participation for safety, misconduct, nonpayment, ineligibility, or rule violations; and
  • Take reasonable steps to protect participants, volunteers, staff, and ministry operations.

Unless FaithAGT expressly agrees otherwise, participants are responsible for travel, lodging, transportation, personal property, and other costs associated with attendance.

Meal preferences, dietary information, allergies, accessibility requests, and accommodations should be submitted accurately and promptly. FaithAGT will make reasonable efforts to address requests but cannot guarantee an allergen-free environment or every requested accommodation.

18. Children and Youth Participation

A parent, legal guardian, or authorized adult must complete registrations and provide consent for a minor where required.

The person registering a minor represents that the person has authority to:

  • Register the minor;
  • Provide relevant contact, emergency, dietary, allergy, medical, pickup, and accommodation information;
  • Authorize participation in identified activities;
  • Make media-consent selections; and
  • Receive communications regarding the minor’s participation.

FaithAGT may require additional waivers, emergency-contact information, pickup authorization, conduct agreements, medical information, or consent before a minor participates in a specific program.

Parents and guardians are responsible for informing FaithAGT promptly of material changes affecting a minor’s safety or participation.

19. Food Pantry and Community Outreach Ministries

The Food Pantry is a ministry of Faith Apostolic Gospel Temple. FaithAGT may also operate other charitable assistance, community service, seasonal outreach, or relief programs.

Participation may be subject to service-area, appointment, household, frequency, inventory, funding, grant, eligibility, identification, or documentation requirements. Requirements may vary by program and may change based on available resources or applicable rules.

By requesting assistance, you agree to provide information that is accurate to the best of your knowledge. FaithAGT may verify information where reasonably necessary to administer a program, prevent duplication or misuse, satisfy grant or funding obligations, or promote fair access.

Food, supplies, appointment times, quantities, selections, and assistance are subject to availability. Registration or an appointment does not guarantee that a particular item, quantity, brand, dietary option, or level of assistance will be available.

FaithAGT may establish reasonable distribution, safety, conduct, pickup, proxy, household, and appointment procedures. FaithAGT may deny, postpone, limit, or discontinue assistance where:

  • Inventory or program capacity is unavailable;
  • Program requirements are not met;
  • Information is materially false or fraudulent;
  • There is threatening, abusive, unsafe, or disruptive conduct;
  • Program misuse or unauthorized resale is reasonably suspected;
  • Applicable grant, legal, funding, or operational rules require it; or
  • FaithAGT determines that action is reasonably necessary for safety or fair administration.

Food Pantry and outreach records are handled in accordance with FaithAGT’s Privacy Policy. Receipt of assistance does not create an employment, membership, agency, fiduciary, or contractual relationship beyond the specific assistance provided.

FaithAGT does not guarantee that food, household goods, or other distributed items will be suitable for every person. Recipients are responsible for reviewing packaging, ingredients, expiration or best-use information, preparation instructions, and allergy considerations before use.

20. Volunteer Participation

Submitting a volunteer form does not guarantee assignment, placement, or continued service. FaithAGT may consider ministry needs, availability, skills, experience, conduct, safety, qualifications, training, and other relevant factors.

Volunteers agree to:

  • Provide accurate information;
  • Follow applicable ministry policies, safety rules, and instructions;
  • Protect confidential and personal information;
  • Use FaithAGT systems, records, equipment, and resources only as authorized;
  • Avoid harassment, discrimination, retaliation, abuse, exploitation, or unsafe conduct;
  • Report suspected safety, privacy, security, or misconduct concerns promptly; and
  • Return FaithAGT property and discontinue access when service ends.

Volunteer service is not employment and does not create a right to wages, benefits, continued placement, or a particular assignment unless a separate written agreement states otherwise.

FaithAGT may reassign, suspend, or end volunteer service at any time where legally permitted.

21. Photography, Video, Audio, and Media

FaithAGT may photograph, audio-record, video-record, or otherwise document worship services, conferences, events, Food Pantry activities, community outreach, volunteer service, youth programs, and other ministry activities.

Media may be used for religious, educational, historical, archival, communications, website, social-media, promotional, livestream, broadcast, and printed-publication purposes.

FaithAGT may obtain consent through registration, visitor, participant, volunteer, youth, or media-release forms. Parents or guardians make applicable media-consent selections for minors.

Attendance at a public, photographed, recorded, or livestreamed activity may result in an incidental appearance in background video, audio, or photography. FaithAGT will make reasonable efforts to honor documented restrictions where practical, but cannot guarantee exclusion from every wide-angle, crowd, background, archived, or third-party recording.

Requests regarding specific FaithAGT-controlled media may be submitted to us. FaithAGT cannot guarantee removal from printed materials, archived productions, third-party platforms, reposted content, or materials no longer under FaithAGT’s control.

22. Livestreams and Recorded Services

FaithAGT may livestream and archive worship services, conferences, ceremonies, teaching sessions, and other events.

Livestreams and recordings may experience delays, interruptions, errors, sound or video issues, platform outages, schedule changes, or loss of availability. FaithAGT does not guarantee uninterrupted access or permanent archiving.

Comments, chats, or interactions made through an external video or social-media platform may be public and are subject to the platform’s rules and privacy practices. FaithAGT may moderate or remove comments where possible.

Do not rely on a livestream for emergency, safety-critical, or time-sensitive instructions unless FaithAGT expressly identifies it for that purpose.

23. SMS and MMS Messaging Terms

23.1 Program Description

When you opt in, FaithAGT may send recurring conversational, informational, and ministry-related SMS or MMS messages. Messages may include:

  • Worship-service and ministry announcements;
  • Event, conference, and program reminders;
  • Registration, ticket, attendance, and participation information;
  • Schedule, location, cancellation, emergency, and weather-related updates;
  • Volunteer scheduling and assignment communications;
  • Food Pantry and community outreach notifications;
  • Prayer, devotional, and ministry encouragement messages;
  • Visitor, member, and ministry follow-up;
  • Donation or giving-related administrative messages;
  • Responses to inquiries you initiate; and
  • Other messages consistent with the program for which you opted in.

23.2 Consent

By providing your mobile number and affirmatively opting in, you consent to receive messages consistent with the applicable opt-in disclosure.

Consent is not a condition of making a donation, purchasing a ticket, registering for an event, receiving Food Pantry assistance, receiving ministry services, or otherwise interacting with FaithAGT.

You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to messages at that number.

23.3 Frequency and Charges

Messaging frequency may vary. Message and data rates may apply. Your wireless carrier’s rates, terms, and conditions apply.

23.4 Opt-Out

You may opt out at any time by replying STOP. After you send STOP, FaithAGT or its messaging provider may send a confirmation that you have been unsubscribed. No additional messages should be sent from that program unless you opt in again, although legally required, security, or other permitted messages may apply in limited circumstances.

If you participate in more than one distinct messaging program, you may need to opt out separately from each program.

23.6 Privacy and Mobile Information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with third parties or affiliates for their marketing or promotional purposes.

Mobile information and messaging data may be provided to service providers and subcontractors supporting message delivery, communications infrastructure, customer service, security, fraud prevention, recordkeeping, and regulatory compliance. They may use the information only to provide approved support services or as required by law.

23.7 Carrier and Delivery Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your device, carrier, service availability, network conditions, and other factors outside FaithAGT’s control.

23.8 Number Changes

Notify FaithAGT or opt out before transferring, disconnecting, or reassigning your mobile number. You agree not to provide a number you are not authorized to use.

23.9 Program Changes

FaithAGT may modify, suspend, or discontinue a messaging program, subject to applicable law. Program-specific opt-in disclosures may supplement these Terms.

24. Email and Other Communications

FaithAGT may send newsletters, announcements, event reminders, volunteer communications, giving statements, birthday greetings, visitor follow-up, ministry information, transaction confirmations, and other requested or authorized communications.

You may unsubscribe from nonessential marketing or informational emails using an available unsubscribe link or by contacting us. FaithAGT may still send transactional, donation, registration, security, safety, legal, or administrative messages.

Email and internet communications may be delayed, intercepted, misdirected, filtered, or unavailable. Do not use ordinary email to send complete payment details or unnecessary highly sensitive information.

25. Third-Party Services and Links

FaithAGT uses trusted third-party providers for hosting, content delivery, website security, backups, forms, ministry relationship management, payments, email, messaging, analytics, tag management, video, maps, spam prevention, and technical support.

Third-party services and websites are governed by their own terms and privacy practices. FaithAGT does not control and is not responsible for:

  • The content, security, accuracy, availability, or practices of an unaffiliated service;
  • Changes made by a third-party provider;
  • A provider’s suspension, interruption, or termination of service;
  • Third-party fees, accounts, or technical requirements; or
  • Information you independently provide directly to a third party.

A link, integration, or embedded feature does not necessarily constitute endorsement of the provider or all content available through it.

26. Cookies, Analytics, and Embedded Features

The website may use cookies, analytics, tag-management tools, session and usability technologies, embedded videos, maps, spam-prevention tools, and similar features.

Where required, FaithAGT uses a consent-management tool to present cookie choices and record preferences. For more information, review our Cookie Policy and Privacy Policy.

Disabling cookies or scripts may prevent certain features from functioning correctly.

27. Artificial Intelligence

FaithAGT may use artificial intelligence or AI-assisted tools for administrative purposes such as meeting summaries, information organization, and drafting or improving communications.

AI-assisted output is subject to human review. FaithAGT does not use AI to make fully automated decisions concerning membership, ministry participation, volunteer eligibility, charitable assistance, donations, pastoral care, counseling, or legal rights.

AI output may contain errors, omissions, or outdated information. It should not be treated as authoritative without appropriate review.

28. Accessibility

FaithAGT strives to make its website and digital Services accessible to people with disabilities and works toward recognized accessibility standards and applicable requirements.

To report an accessibility barrier or request information in an alternative format, contact ministry@faithagt.org.

FaithAGT will make reasonable efforts to respond and provide access, but cannot guarantee that every third-party platform or embedded service meets every accessibility standard.

29. Security and Availability

FaithAGT uses reasonable safeguards designed to protect the Services and personal information, including managed hosting, encrypted website communications, content delivery and web application firewall protections, automated backups, multi-factor authentication, role-based permissions, password requirements, access logging, and security monitoring where appropriate.

No system, communication, transaction, or storage method is completely secure. FaithAGT cannot guarantee that the Services will be free from unauthorized access, malware, errors, vulnerabilities, delays, outages, data loss, or other security events.

You are responsible for protecting your devices, accounts, networks, and communications. Notify FaithAGT promptly if you become aware of suspected misuse or unauthorized access involving the Services.

FaithAGT may perform maintenance, apply security controls, restrict access, or suspend a feature without notice when reasonably necessary to protect security or operations.

30. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.”

FaithAGT disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, noninfringement, title, accuracy, reliability, availability, security, and uninterrupted operation.

FaithAGT does not warrant that:

  • The Services will always be available, uninterrupted, timely, accurate, secure, or error-free;
  • All content will be complete, current, or suitable for every purpose;
  • Defects will be corrected immediately;
  • The Services will be free of malware or harmful components;
  • An event, ministry, speaker, program, item, benefit, or service will remain available;
  • A prayer, ministry, pastoral, charitable, or volunteer request will produce a particular outcome; or
  • Third-party services will function as expected.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law.

31. No Professional Advice or Emergency Services

Content and communications provided through the Services are for religious, ministry, charitable, educational, and general informational purposes.

They do not constitute medical, mental-health, legal, financial, tax, insurance, nutritional, emergency, or other licensed professional advice. Consult an appropriate qualified professional regarding your circumstances.

The website, email, SMS, prayer forms, and counseling-request forms are not emergency-response systems. In an emergency or if a person may be in immediate danger, contact 911 or the appropriate local emergency service.

32. Limitation of Liability

To the fullest extent permitted by law, FaithAGT and its pastors, officers, trustees, directors, employees, volunteers, agents, contractors, ministry leaders, affiliates, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of data, revenue, profits, opportunity, goodwill, or use, arising from or related to:

  • Access to, use of, or inability to use the Services;
  • Reliance on website content or communications;
  • Errors, omissions, interruptions, delays, outages, security incidents, or data loss;
  • Third-party websites, platforms, payment services, communications, or content;
  • Events, registrations, cancellations, livestreams, or program changes;
  • Food Pantry or community outreach availability, inventory, or participation;
  • User Content or another person’s conduct; or
  • Any other matter relating to the Services.

To the fullest extent permitted by law, FaithAGT’s aggregate liability for a claim arising from the Services will not exceed the amount you paid FaithAGT for the specific transaction or service giving rise to the claim during the six months before the event, or one hundred United States dollars ($100), whichever is greater.

The foregoing limitations do not apply where prohibited by law and do not limit liability that cannot lawfully be excluded, including liability for intentional misconduct or other nonwaivable obligations.

33. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless FaithAGT and its pastors, officers, trustees, directors, employees, volunteers, agents, contractors, ministry leaders, and affiliates from claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising out of or relating to:

  • Your unlawful or improper use of the Services;
  • Your violation of these Terms;
  • Information or User Content you submit;
  • Your violation of another person’s privacy, intellectual property, or other rights;
  • Your fraudulent, deceptive, threatening, abusive, or unsafe conduct; or
  • Your unauthorized registration of, or submission of information about, another person.

This section does not require indemnification to the extent prohibited by applicable law.

34. Suspension, Termination, and Enforcement

FaithAGT may restrict, suspend, or terminate access to a Service; cancel a registration; remove content; discontinue communications; end volunteer access; or take other reasonable action if FaithAGT believes that:

  • These Terms or another applicable policy have been violated;
  • Information is fraudulent, materially false, or unauthorized;
  • Conduct presents a safety, security, privacy, legal, or operational risk;
  • A payment is unauthorized, reversed, or unpaid;
  • A service is being abused or disrupted;
  • FaithAGT is required to act by law, a court, a regulator, a carrier, a platform, or a service provider; or
  • Restriction is reasonably necessary to protect FaithAGT or others.

FaithAGT’s failure to enforce a provision immediately does not waive the right to enforce it later.

35. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where federal law or another mandatory law applies.

Unless applicable law requires otherwise, a legal action arising from these Terms or the Services must be brought in a state or federal court with jurisdiction over Westchester County, New York, and the parties consent to the jurisdiction and venue of those courts.

Nothing in this section prevents FaithAGT from seeking temporary, injunctive, protective, or equitable relief in another court with proper jurisdiction.

36. Changes to These Terms

FaithAGT may update these Terms to reflect changes in ministry operations, events, programs, technology, law, security practices, communications, or organizational needs.

Updated Terms will be posted with a revised “Last Updated” date. Changes become effective when posted unless another effective date is stated. Where required by law, FaithAGT will provide additional notice or obtain consent.

37. General Provisions

37.1 Entire Agreement

These Terms, the Privacy Policy, the Cookie Policy, and any applicable program-specific terms or written agreement constitute the agreement governing use of the applicable Services.

37.2 Severability

If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent, and the remaining provisions will remain in effect.

37.3 No Waiver

Failure to enforce a provision does not waive that provision or any other right.

37.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without FaithAGT’s written consent. FaithAGT may assign or transfer its rights and obligations in connection with an organizational restructuring, ministry transition, service-provider arrangement, or other lawful purpose.

37.5 No Third-Party Beneficiaries

Except where these Terms expressly provide otherwise, they do not create rights for a third-party beneficiary.

37.6 Headings

Headings are provided for convenience and do not limit the meaning of a provision.

37.7 Electronic Communications

You consent to receive notices and records electronically where permitted by law. Electronic notices may be provided through the website, email, messaging, or another reasonable method.

37.8 Survival

Provisions that by their nature should continue after termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and general provisions.
